Probate and Family Provision List

SC EQ 07

On 13 June 2024, the Chief Justice reissued Practice Note SC EQ 07 – Probate and Family Provision List, with a commencement date of 17 June 2024. 

The revised Practice Note makes the following changes: 

• The list previously known as the Succession and Probate List is renamed as the Probate and Family Provision List.

• Matters in the List will be managed by a Probate and Family Provision List Judge with the assistance of the Registrar in Probate.

• Probate proceedings will be managed by the Registrar in Probate in a List on Tuesdays.

• Family Provision applications will be managed by the Registrar in Probate in a List on Thursdays.

• The Registrar may refer matters to a judge on both days. In addition, a judge will ordinarily be available for the Registrar to refer matters to on Fridays.

• Unless the Registrar in Probate is unavailable, all urgent applications must, in the first instance, be referred to the Registrar in Probate who may refer the matter to a judge.

• Court annexed mediations will be listed on the presumption of a half-day estimate unless there are factors warranting a longer estimate.  Parties are expected to personally attend the mediation absent exceptional circumstances.

The reissued Practice Note will be published on the Supreme Court website and will be submitted for gazettal.
