TORTS – the applicant seeks to appeal from a decision dismissing allegations of sexual assault founding causes of action in torts of assault and trespass on the person. The dispute relates to alleged sexual misconduct in around 1971 by the respondent (as an 18-year-old) towards the applicant (as a 6-year-old) as neighbours. On appeal, the applicant only contests liability, although challenges numerous factual findings and the standard of proof in historical sexual abuse cases.
